Thank you for visiting zyla.com.au. By accessing, using or browsing this site, you acknowledge that you have read, understood and agree to be bound by the following terms and conditions. If you do not agree with any of these terms and conditions of use, please do not use this site. All information is subject to change without prior notice, so please ensure that you re-read our terms and conditions before making each purchase.
Site material, information and content
Whilst we do our best to ensure that information on the site is correct, Zyla does not warrant or represent any information viewed and accessed on the site as accurate, current and/or complete. Zyla does not in any circumstance accept any liability for error or omission.

Product displays
While we attempt to display as accurately as possible the colours of the products shown on our site we cannot guarantee that the colour you see match the product colour exactly. The colours you see will depend on many factors, including your monitor or printer.

Sizing charts
Sizing varies from label to label, and where possible we have included size charts in item descriptions. We ask that you check sizing, pictures and descriptions carefully before purchasing. If you have any questions regarding size, we will be more than happy to help you.

Availability of products
Zyla will endeavour to make the products available for purchase from the site at all times. However from time to time, due to heavy demand or factors beyond our control, Zyla may render the products temporarily or permanently unavailable. We will endeavour to notify customers if this will affect their orders in any way.

Orders
Online orders will be completed once checkout proceeds through the secure payment system PayPal. An e-mail confirmation of the order will be sent to the customer's registered email address. A hard copy of the tax invoice in respect of the purchase will be sent with the item when dispatched.
Zyla reserves the right to review and/or to cancel orders containing information that cannot be verified.
Zyla reserves the right to refuse or cancel any order when (a) products are unavailable for any reason; (b) an order placed through the site has not been received by Zyla for any reason; (c) full payment for the order has not been received by Zyla from the customer; (d) order received that may or is involved in any fraudulent activity.

Pricing
The price as it appears on this website is a representation of the price and is not binding if an error has been made. All prices listed on Zyla.com.au are listed in Australian Dollars (AUD) and are exclusive of delivery charge.
Prices indicated on the site include Australian Goods and Services Tax (GST). When goods are sold for export, these are exempt from this tax. This reduction is not available to Australian residents.

PayPal Payment option:
When paying via PayPal’s secure online payment process. We do not see your credit card number or bank account details which limits the risk of fraud and identity theft. PayPal also offer coverage of up to $3,000 with PayPal Buyer Protection. Terms & conditions apply. Go to www.paypal.com.au for more information. You do not have to sign up with PayPal to pay through PayPal.

Security
Zyla takes every precaution to make our site as secure as possible. Zyla follows the industry standard, Secure Sockets Layer protocol, “SSL”, for the transfer of sensitive data over the internet. SSL is used to encrypt and protect the data you send us over the internet to ensure that your details are safe. We do not hold any payment details on record.

Delivery
We dispatch all orders within 24 hours of receipt of payment, ensuring you receive your order as quickly as possible.
All customers within Australia will be charged a flat postage fee of $8.50 per order.
Any purchases made within Australia will be delivered by Australia Post/Express Post. Orders placed and paid for on the same day will most likely receive their parcel within 2 business days. Please be aware that large orders or heavy items can take longer to be delivered, these items are not sent express post.

Please allow for public holidays and weekends when waiting for your order. Although every effort is made for next day delivery. Australia Post do not deliver on weekends or public holidays.
To ensure prompt delivery, we recommend your nominated delivery address is one where someone is present to accept your delivery between the hours of 9.00am and 5.00 pm. If the package is too large for the post box and there is no one home to collect it, a calling card will be left by Australia Post. You will then be required to collect the item from your nearest Australia Post Office. Zyla does not accept liability for a delay in the event that there is no one to receive the order at the delivery address.
If you require special delivery instructions for your goods you will be able to enter these details during the checkout process. (For example, perhaps the goods must be left at the reception of your workplace, or the mailbox is located down the side lane). We can also deliver items to a different recipient (ie. for a gift) just make sure you specify their correct address in the checkout process.
Please note if there is any foreseeable delay in the delivery of your order, you will be contacted by a member of the Zyla team.
International orders
New Zealand orders are a flat postage of AUD $15.00 via Air Mail, and can take anywhere from 3-10 business days to arrive.

All material contained within the site including images, icons, logos, graphics, illustrations, text elements, site design and functionality are the copyright of Zyla.
Zyla is proud to feature several fashion designers throughout our website. Please be aware that each of the company's trademarks, brand/product names, product photos and logos displayed on this web site are used for identification and information purposes only and are registered trademarks of their respective owners who reserve all of their rights and ownership.
Material from zyla.com.au may not be copied, downloaded, reproduced, republished, uploaded, posted, transmitted, or distributed in any way. Modifications, alterations, or any types of changes of the materials or use of the materials for any purpose other than your own personal; or non-commercial home use, is a violation of the copyrights and other property rights held by Zyla, or affiliated companies, or by other third parties. Nothing in this site grants you any license or right to use any Trademark displayed on this site without the written permission from the owner of the Trademark.
General
These terms and conditions and your use of this site shall be governed by and construed in accordance with the laws of New South Wales, Australia.

Returns Policy

We understand that buying online can be quite daunting since you can't touch and try it on before you buy. That is why we offer a hassle free returns policy.
We value our customers at Zyla.com.au and want to ensure you enjoy your online shopping experience and are satisfied with your purchase. If you are dissatisfied with your order in any way, please contact us at info@zyla.com.au within seven (7) days of purchase to discuss an exchange, refund or credit note.
We are happy to accept returns that have not been worn, have all the tags attached and are in brand new condition. Please note that swimwear will only be accepted if the hygiene strip is still in place. Any returned product must reach us in its original, undamaged packaging. The customer is responsible for ensuring that the product is packaged appropriately for return freight.
The returned item must be received by Zyla within 14 days of purchase.
Once the product is received and has undergone a quality control check to ensure the product is in its original condition the new size will be dispatched or a refund credited to your account. If you wanted to exchange your item and the exact same item is not available you may choose a different item (any price difference must be paid by you, or refunded by us if the new item is cheaper than the original purchase.)
If Zyla quality control notes that the item has been damaged or worn we reserve the right to return the item back to you with no refund or exchange.

Sale items: For sale goods or discount codes we are unable to offer a refund, however you are welcome to exchange or have a store credit issued to you, unless otherwise stated in the sale promo.

Gifts: If you are purchasing a gift for someone please contact us and we will arrange a longer returns policy. Christmas gifts purchased during December may be returned for refund or exchange within 14 days of Christmas Day, subject to the above conditions.

Credit note: If you elect for a credit note (store credit), this enables you to purchase something later from Zyla.com.au to the same value of the returned item (excluding the postage and handling costs). There will be a 6 month expiry date on your credit note.

Order Cancellations: If you decide to cancel your order before it has been shipped. You will incur a $1.00 transaction fee to reverse the payment.
Please note, when returning your item we strongly recommend that you use a postal service which is able to trace the whereabouts of your goods, ensuring it reaches us safely (i.e. registered post/express post). It is your responsibility to ensure the goods arrive safely to the return address. Unfortunately any item that goes missing in the post will not be credited. We will contact you via email as soon as we receive the goods to notify you of the exchange/refund.
We regret that we are unable to refund the original postage and handling costs, unless the item was faulty or not as ordered. You will also be responsible for the cost of the return postage. However, outward shipping will not be charged to you on your first size exchange.
